We are a leading fee-for-service NDIS legal practice. Intrepidus Law can represent you throughout the life of your NDIS planning relationship with the NDIA.

We can remove an enormous administrative burden and stress for people with disability, their families and carers.

Intrepidus Law provides legal advice and legal representation in the following areas:

ADMINISTRATIVE APPEALS TRIBUNAL Legal representation and Advice - NDIS Appeals

When an Internal Review does not result in your desired outcome, the next step is an External Review (an appeal) at the Administrative Appeals Tribunal (AAT). Intrepidus Law can provide legal advice and legal representation for you at the AAT, ranging from representing and advising you through Case Conferences, Conciliation, Summons requests, Direction Hearings, Interlocutory Hearing and final Hearing. Only a solicitor can offer legal advice and legal representation. A non-legal NDIS Appeals advocate cannot provide legal advice or legal representation.

ACCESS TO THE NDIS

Obtaining access to the National Disability Insurance Scheme (NDIS) can be life-changing. It is important to get your application and supporting evidence right to gain access to the NDIS. Intrepidus Law can provide legal advice on your supporting evidence and act for you in your application to access the NDIS. We can represent you in your appeal to the AAT if your access to the NDIS is denied.

LEGAL ADVICE ON NDIS REASONABLE & NECESSARY SUPPORTS

Only a Solicitor can provide legal advice on the strength of your evidence to justify NDIS reasonable and necessary supports.

Intrepidus Law can review your specialist evidence and provide a Legal opinion on whether the evidence satisfies the legislative criteria of the NDIS Act and relevant NDIS Rules.

Be wary of “Advocates” who have no legal qualifications and charge for a review of your evidence and allied health reports. Only a Solicitor with a Practicing Certificate can lawfully charge for legal services. You can not use your NDIS plan to pay for advocacy or legal advice.

ADMINISTRATIVE APPEALS TRIBUNAL LEGAL REPRESENTATION & ADVICE

The Principal Solicitor of Intrepidus Law has achieved exceptional results at the AAT in appeals regarding:

  • Achieving Access to the NDIS when access has been denied by the NDIA
  • Increasing capacity-building supports
  • Increasing Support Worker hours and Core supports
  • SDA (Specialist Disability Accommodation) Appeals:
    • Achieving eligibility for SDA and appealing decisions denying eligibility
    • Achieving single occupancy SDA where the NDIA is insisting the person with a disability share SDA and that person has a preference to reside alone.
  • Achieving 24/7 1:1 or 2:1 (support to client ratio) support for eligible people with disability who want to reside alone and not share supports with a stranger, for example where the agency insists upon funding a 1:2 or 1:3 ratio of support and sharing accommodation
  • Support for disabled children and their families, in particular Support Worker assistance for children. If the NDIA has provided you with a “Parental Responsibility” argument against support worker assistance for your child, we can assist you with legal advice and representation.
